CODE OF CONDUCT AGAINST THE SEXUAL EXPLOITATION OF CHILDREN AND ADOLESCENTS

In accordance with Law No. 28251, the “Law against abuse and sexual exploitation,” which incorporated crimes of user-client and sexual exploitation of children and adolescents in the field of tourism, we consider the MINIMUM COMMITMENTS THAT ALL TOURISM SERVICE PROVIDERS MUST ASSUME.

In order to counteract the sexual exploitation of children and adolescents in travel and tourism, tourism service providers will adopt a Code of Conduct that must be observed by their legal representatives, directors, administrators, employees, and contractors involved in the provision of tourism services. This is to enforce the obligations contemplated in Law 28251 and to prevent the behaviors stipulated in the same law. It should also include the following minimum control measures:

• Refrain from including in tourism promotion programs and tourist plans, explicitly or surreptitiously, plans for the sexual exploitation of children and adolescents.
• Refrain from providing tourists, directly or through intermediaries, with information about places where the commercial sexual exploitation of children and adolescents is coordinated or practiced.
• Refrain from transporting tourists, directly or through third parties, to establishments or places where the commercial sexual exploitation of children and adolescents is practiced, as well as transporting them to the places where tourists are accommodated, even if they are ships located at sea, for the purpose of commercial sexual exploitation of children and adolescents.
• Refrain from providing vehicles on tourist routes for the purpose of sexual exploitation or abuse with children and adolescents.
• Prevent the entry of children and adolescents into hotels or accommodation places, bars, similar businesses, and other establishments that provide tourism services, for the purpose of exploitation or sexual abuse.
• Take measures to prevent personnel associated with the company from offering tourism services that allow sexual activity with children and adolescents.
• Report to MINCETUR (Ministry of Foreign Trade and Tourism) and other competent authorities any incidents of which it becomes aware through any means, as well as the existence of places related to the sexual exploitation of children and adolescents, and ensure that there are channels for reporting to the competent authorities within the company.
• Design and disseminate within the company and with its suppliers of goods and services, a policy in which the provider establishes measures to prevent and counteract all forms of sexual exploitation of children and adolescents in travel and tourism.
• Train all personnel associated with the company on the topic of preventing commercial sexual exploitation of children and adolescents.
• Inform users about the legal consequences in Peru of the exploitation and sexual abuse of children and adolescents.
• Display this Code of Conduct and any other commitments and measures that the provider wishes to undertake to protect children and adolescents in a visible place for the employees of the establishment or businesses.

“In compliance with the provisions of Law No. 28251, the agency warns tourists that the exploitation and sexual abuse of minors in the country are subject to criminal and administrative sanctions, in accordance with the current laws.”
